What is a template employment contract?
A template employment contract is an employment contract that you can reuse for different employees of similar seniority who are covered by the same modern award.

- Employees at different levels of seniority have different expectations and obligations, and
- Employees covered by different modern awards require employment contracts that comply with the applicable modern award.
For example, in a mid-sized technology company that does not have an enterprise agreement, the employer will likley use separate template employment contracts for:
- The CEO and members of the executive leadership team. Those template contracts would (among other things):
- Have longer notice periods.
- Impose more onerous post-employment restraints.
- Include director or office holder resignation obligations.
- Protect the employer in relation to the ‘golden handshake’ provisions in the Corporations Act.
- Management employees not covered by any modern award or enterprise agreement.
- Developers covered by the Professional Employees Award on the basis they require a computer science degree recognised by the Australian Computer Society to perform any of their duties.
- Reception and administration employees covered by the Clerks – Private Sector Award (including People and Culture employees).
How do I know if a modern award covers an employee?
Although it is important that employers know if each employee is covered by a modern award, assessing modern award coverage is unfortunately complicated and uncertain.
